In early 2025, the appointment of Ed Martin as the interim U.S. Attorney for the District of Columbia signaled a dramatic and highly controversial departure from the traditional, nonpartisan norms of federal law enforcement. Martin, a staunch political loyalist who had actively championed the lie that the 2020 presidential election was stolen and participated in the march on the Capitol on January 6, possessed zero prior experience as a state or federal prosecutor. Almost immediately upon taking office, Martin undertook a series of aggressive, highly regularized initiatives designed to protect the Trump administration and retaliate against its political adversaries. Among the most legally questionable of these campaigns was “Operation Whirlwinds,” a highly publicized initiative targeted at high-level Democratic officials.
Officially, Martin framed Operation Whirlwinds as a necessary crusade to “stop the storm of threats against officials at all levels”. In practice, however, the operation functioned as a partisan dragnet aimed at converting years-old political metaphors and constitutional criticisms into federal crimes. The primary target of this operation was Senate Majority Leader Chuck Schumer. Martin sought to criminally prosecute Schumer for a public comment made five years earlier, in March 2020, during an abortion rights rally on the steps of the Supreme Court. At that rally, Schumer had addressed conservative Justices Neil Gorsuch and Brett Kavanaugh directly, stating: “I wanna tell you, Gorsuch, I wanna tell you, Kavanaugh, you have released the whirlwind and you’ll pay the price”. Although Schumer had formally apologized for the injudicious phrasing the very next day, and the remarks had not impeded the Court’s subsequent rulings, Martin sought to retroactively classify the statement as a criminal threat. He fired off a series of hostile, threatening emails demanding that the Senator “clarify his comments from five years ago”.
Schumer was not the only federal official targeted under the Operation Whirlwinds umbrella. Martin also turned his sights on Democratic Representative Robert Garcia. During a CNN interview, Garcia had utilized a standard political metaphor, stating: “And what the American public want is for us to bring actual weapons to this bar fight. This is an actual fight for democracy”. Seizing on this comment, Martin sent Garcia a formal warning accusing him of making a physical threat against billionaire Elon Musk—the newly appointed co-head of the Department of Government Efficiency (DOGE)—and the government staff working under him. Martin’s letter suggested that the metaphorical reference to a “bar fight” constituted a real threat, particularly since Garcia had previously called Musk a “dick” on television.
The legal and logical foundations of Operation Whirlwinds were widely derided by veteran legal experts and career prosecutors. As commentators pointed out, it is not a federal crime to call Elon Musk a “dick,” nor does the use of standard political metaphors about a “bar fight” satisfy the legal threshold for a criminal threat. More glaringly, the five-year statute of limitations on criminal incitement had already expired for Schumer’s 2020 speech, meaning that, as a matter of law, “that whirlwind has whirled”. Furthermore, the manner in which Martin conducted the operation violated basic Department of Justice protocols. Rather than executing proper, confidential criminal procedures—such as interviewing witnesses, convening a grand jury, or filing formal criminal charges—Martin relied on sending “pissy” public emails and generating sensational political discussions from his official account.
Ultimately, Martin’s attempt to escalate the operation failed due to resistance from professional, career prosecutors. When Martin attempted to get the professional prosecutors at Main Justice to formally authorize indictments or grand jury proceedings under Operation Whirlwinds, he was flatly blown off. Main Justice recognized that the cases were completely devoid of legal merit and predication. By attempting to weaponize the U.S. Attorney’s office to criminally prosecute political opponents for protected speech, Operation Whirlwinds stood as a stark illustration of the degradation of prosecutorial ethics and the rule of law during the second Trump administration.
